1.3. WHAT PERSONAL DATA DOES CRYPTOCOMPASS COLLECT AND PROCESS?

We collect and process personal data that you provide to us directly or that we generate as part of our business or prospecting relationship with you. Personal data includes information that directly identifies you as an individual, such as your name, email address, or telephone number. It also includes information that, when combined with other data, can identify you, such as your job title, demographic details (e.g., gender, location), or technical data (e.g., IP address).

In addition to personal data received directly from you, we may also collect and processes personal data about you from public sources (e.g., the Internet, social media) third parties.

We collect and process the following categories of personal data:

  • Personal and professional contact information - personal data provided during the preparation and execution of contracts, such as your name, address, email address, date of birth, company name, job title, correspondence, and inquiries.
  • Technical information - personal data that is automatically transmitted and collected when using our Sites and web analytics tools, such as Google Analytics. It may include the date and time of access, names of files downloaded, data volume transmitted, access results, browser type and language, the requesting domain, and your IP address.
  • Marketing, advertising, and sales data - personal data generated from marketing, advertising, and sales initiatives.
  • Publicly available data - data from social media platforms, such as usernames, names, and contact details.
  • Other personal data comparable to the categories outlined above.


1.4. FOR WHAT PURPOSE AND ON WHAT LEGAL BASIS DO WE USE YOUR PERSONAL DATA?

We only collect personal data necessary for specific, lawful purposes.

1.4.1. To fulfill contractual obligations or take steps prior to entering a contract

We process personal data to provide you with contractually agreed services, perform contracts with you, or grant you access to our platform based on a subscription with your company or a demo access prior to entering a potential contract.

1.4.2. To pursue and protect legitimate interests of CryptoCompass

This includes communication with you regarding your inquiries and potential interests, initiating a business relationship or contract, identifying and analyzing your needs, optimizing client contact, business development, advertising, marketing, conducting market research or surveys, and safeguarding IT security and operations.

1.4.3. On the basis of your consent

In particular cases, we process personal data based on your explicit consent. If consent is provided, we use personal data for the specified purposes. You may withdraw your consent at any time. Please note that the withdrawal of consent has no retroactive effect on the processing of your personal data.

1.4.4. Recording of electronic communication

We may record and archive electronic communication between you and CryptoCompass, with or without prior notice. Such recordings may be used to meet legal or regulatory obligations, ensure compliance, or conduct performance checks. Recordings may also be used for training and quality assurance purposes.

1.4.5. To assess job applicants and perform employment contracts

We process personal data provided during the application process to evaluate compatibility with advertised positions, including CVs, work experience, references, and compensation details. Publicly available information may also be reviewed.

1.4.6. Use of identifiable photographs and comments

We may use your photographs and comments, including personal stories shared with us, but only after making a prior announcement.

1.4.7. On the basis of regulatory requirements and legal obligations

CryptoCompass’s activities are subject to various Swiss and foreign laws and regulations. We may archive user activity logs to comply with legal and regulatory obligations, such as anti-money laundering requirements, compliance checks, reporting, risk management, and record-keeping.


1.5. WHO CAN ACCESS YOUR PERSONAL DATA?

1.5.1. Disclosure to business partners and other third parties

Your personal data may be shared with business partners and third-party service providers who assist in delivering and analyzing advertising, marketing, and communication campaigns, as well as performing marketing and sales activities, reporting, logistics, and printing services.

Additionally, third parties acting on our instructions, such as recruitment agencies, hosting or security providers, and IT developers, may access your data. These entities are required to adhere to strict confidentiality and data protection standards.

1.5.2. Disclosure to authorities and regulatory bodies

Where required by law or regulation, or when necessary to fulfill security, legal, or fiscal obligations, we may disclose your personal data to public authorities, regulatory bodies, or institutions. This may include providing data to governmental bodies and institutions to meet legal and regulatory requirements.

If third parties, including those located outside your country of access, are granted access to your personal data, CryptoCompass ensures compliance with applicable confidentiality, data protection, and data security standards.


1.6. DOES CRYPTOCOMPASS TRANSFER PERSONAL DATA ACROSS BORDERS?

We may transfer personal data to third parties located outside of Switzerland, as well as to other jurisdictions. These may include member states of the European Union (EU) and European Economic Area (EEA), countries deemed to have an adequate level of data protection as determined by the European Commission, and other regions worldwide where third-party recipients referenced in Section 5 operate or where CryptoCompass markets and delivers its services.

Certain jurisdictions to which your personal data may be transferred might not provide the same level of data protection as is guaranteed under Swiss and EU laws. In such instances, we take appropriate steps to ensure that your personal data is adequately protected. This is achieved through contractual, organizational, and technical safeguards. Such safeguards may include the use of standard contractual clauses (SCCs) approved by the European Commission and the Swiss Federal Data Protection and Information Commissioner (FDPIC), among other measures.


1.7. HOW DOES CRYPTOCOMPASS STORE, SECURE AND RETAIN DATA?

We take all reasonable technical and organizational measures to protect the personal data we hold against loss, unauthorized access or disclosure, and other forms of misuse. Your personal data will not be sold or disclosed to any other third parties except as provided in this Privacy Notice.

When personal data we collect is no longer required for the given purpose or legal requirements, we securely destroy or delete it. In general, the following retention periods apply:

  • Personal data associated with user accounts on our Sites: retained until the account is deleted. After this period, only data necessary to fulfill security, legal, accounting, or fiscal obligations is retained.
  • Personal data related to users requesting quotes, applying for jobs, sending communications, complaints, or inquiries: retained until the user’s request or complaint has been fully processed. Afterward, it is retained only if necessary for pursuing legitimate interests or fulfilling legal obligations.


1.8. WHAT ARE YOUR RIGHTS UNDER DATA PROTECTION LAW?

Under the applicable data protection laws, you are entitled to the following rights:

  • Access to information: you have the right to request and receive details of the personal data that CryptoCompass holds about you.
  • Correction of data: you may demand that any inaccurate or incomplete personal data be corrected or updated.
  • Deletion of data: you may request the deletion of your personal data if CryptoCompass is neither permitted nor legally obligated to retain it.
  • Restriction of processing: you may request that the processing of your personal data be limited if you dispute its accuracy and the verification is ongoing, or if you object to its deletion despite CryptoCompass lacking a legal basis for processing.
  • Objection to processing: you have the right to object to the processing of your personal data if it is based solely on CryptoCompass’s legitimate interests. In such cases, we will cease processing unless overriding legitimate grounds exist, or the data is necessary to exercise CryptoCompass’s legal rights. This includes the right to object to processing based on your consent (e.g., for direct marketing purposes).
  • Data portability: you may request that personal data you have provided to us be transferred to a third party in a commonly used, machine-readable format.
  • Review of automated decisions: if decisions based solely on automated processing affect you, you may request a review by a natural person and have the right to express your point of view.

Additionally, you have the right to lodge a complaint with the competent data protection authority, such as the Swiss Federal Data Protection and Information Commissioner (FDPIC), if you believe your rights have been infringed.

CryptoCompass requires you to provide certain personal data that is essential for initiating and maintaining a business relationship, as well as for fulfilling related contractual and/or legal obligations. 1.10. IS THE DECISION-MAKING AUTOMATED?

As a general policy, we do not rely on automated decision-making processes for initiating or managing business relationships. In the rare event that such processes are used, we will notify you in advance where required by law.


1.11. IS YOUR DATA PROCESSED AUTOMATICALLY AND USED FOR PROFILING

CryptoCompass may in certain circumstances process your personal data through automated means for the purpose of evaluating specific personal criteria. If such automated processing occurs, we will inform you beforehand and obtain your consent where required by applicable law. Profiling involves any form of automated processing of personal data intended to analyze or predict personal attributes, including preferences, interests, reliability, behavior, location, or movement patterns.

To achieve this, we may use, process, and combine publicly available data with information obtained from third-party sources. For example, profiling may be conducted using assessment tools to provide tailored and relevant information about our products and services.
